ALLGEMEINE GESCHÄFTSBEDINGUNGEN

1. Geschäftsbedingungen
Unsere Geschäftsbedingungen werden durch anders lautende des Bestellers nicht aufgehoben. Sollten einzelne Abschnitte dieser Geschäftsbedingungen unwirksam werden, so berührt dies nicht die Wirksamkeit der restlichen Geschäftsbedingungen. Die unwirksame Bedingung ist durch diejenige zu ersetzen, die dem gewollten Zweck wirtschaftlich am nächsten kommt. Mit einer Bestellung erkennt unser Vertragspartner unsere Geschäftsbedingungen an.

2. Preise 
Für Angebote gelten, sofern die Lieferung nicht innerhalb von 1 Monat nach Vertragsabschluss erfolgt, die am Tage der Lieferung gültigen Preise. Ist der Besteller eine juristische Person des öffentlichen Rechts, ein öffentlich-rechtliches Sondervermögen oder ein Kaufmann, bei dem der Vertrag zum Betrieb eines Handelsgewerbe gehört, so gilt in jedem Falle der am Tag der Lieferung gültige Preis des Lieferers. Nicht vorhergesehene Rohstoff-, Lohn-, Energie- und sonstige Kostenänderungen berechtigen, Verhandlungen über eine Preisangleichung zu verlangen und im Falle der Nichteinigung vom Vertrage zurückzutreten.

3. Versand 
Der Versand unseres Lieferprogrammes erfolgt stets auf Kosten und Gefahr des Auftraggebers. Er erfolgt ab Lager nach unserem Ermessen, wenn eine besondere Versandart vom Besteller nicht vorgeschrieben ist. Beim Empfang der Ware ist unverzüglich der Zustand der Verpackung und der Ware zu kontrollieren. Alle erkennbaren Schäden an der Verpackung und der Ware sind schriftlich auf der Empfangsquittung des Transporteurs festzuhalten.

4. Lieferungsfrist 
Wir sind um die Einhaltung abgesprochener Lieferfristen stets bemüht, haften jedoch für Versäumung derartiger Fristen auch dann nicht, wenn sie mit dem Auftrag bestätigt sind. Schadenersatzansprüche aus Nichteinhaltung von Lieferfrist oder Liefertermin sind ausgeschlossen.

5. Eigentumsvorbehalt 
Die gelieferte Ware bleibt unser Eigentum, bis der Käufer alle Forderungen, die aus der Geschäftsverbindung entstanden sind, erfüllt.

6. Gewährleistung, Garantie 
Beanstandungen wegen unvollständiger oder unrichtiger Lieferung oder erkennbarer Mängel sind unverzüglich, spätestens 8 Tage nach Empfang der Waren, schriftlich vorzubringen. Unsere Verpflichtung bei berechtigten Beanstandungen beschränkt sich auf die Ersatzlieferung oder Reparatur, durch uns. Bei Gewährleistungsreparaturen, welche vorher mit uns abgesprochen wurden, sind die beanstandeten Teile an uns zurück zusenden. Durch Änderungs-, oder Instandsetzungsarbeiten, die der Auftraggeber oder ein Dritter ohne unsere vorherige Zustimmung vornimmt, wird die Gewährleistungsverpflichtung aufgehoben. Die Garantiezeit für das Hand-Bike beträgt 2 Jahre. Die Batterien für unsere Modelle Lipo, Neodrive und Bionx haben ebenfalls 2 Jahre Garantie. Nicht von der Garantie erfasst sind Mängel, die auf Verschleiß oder auf unsachgemäße Behandlung zurückzuführen sind. Verschleißteile sind zum Beispiel: Reifen, Bremsbeläge, Bowdenzüge, Birnen. Ebenfalls Verschleißteile sind Bleigelakkus, darauf gewähren wir ½ Jahr Garantie.

7. Reparaturen 
Bei Reparaturen im Werk, werden die Alt-Teile umgehend entsorgt, außer es wird ausdrücklich eine Rücksendung der Teile gewünscht

8. Haftung 

Für Mangelfolgeschäden oder anderweitige Schadenersatzansprüche wird nur gehaftet, als uns, unseren gesetzlichen Vertretern oder Erfüllungsgehilfen Vorsatz oder grobe Fahrlässigkeit zur Last fällt soweit es den gesetzlichen Bestimmungen entspricht.

9. Zahlungsbedingungen 
Unsere Rechnungen sind zahlbar in Bühl verlustfreier Kasse innerhalb von 30 Tagen ohne Abzug. Wird ausnahmsweise eine andere Regelung zugelassen, muss dies vorher schriftlich vereinbart werden. Zahlt der Käufer trotz Mahnung nicht, sind an dem Eintritt des Verzuges Verzugszinsen zu vergüten. Bei Neukunden bestehen wir auf Zahlung per Vorkasse, abzüglich 3% Skonto.

10. Vorführgeräte
Vorführgeräte, die zum Vorführrabatt gekauft worden sind, dürfen nicht verkauft werden, außer es wird zu normalen "Nicht-Vorführbike-Konditionen" innerhalb einer Woche ein neues Bike bestellt. Wird ein Vorführgerät dennoch verkauft, wird die Rabatt-Differenz nachberechnet.

11. Rücksendung 
Rücksendungen erkennen wir nur nach vorheriger Vereinbarung an. Sie müssen kostenfrei an uns angeliefert werden. Bei Wiedereinlagerung bereits verkaufter Produkte werden wir je nach Zustand der Ware mindestens 10 % des Warenwertes berechnen. Die Kosten für die Rücksendung von Vorführmodellen werden nur dann von uns übernommen, wenn die Abholung von uns veranlasst wird.

12. Urheberrechtschutz 
Sofern wir Abbildungen, Zeichnungen, Gewichts- und Maßangaben überlassen, sind diese Angaben nur annähernd maßgebend, soweit sie nicht ausdrücklich als verbindlich bezeichnet sind. Kostenvoranschläge, Zeichnungen und anderen Unterlagen behalten wir uns Eigentums- und Urheberrechte vor. Sie dürfen Dritte ohne unsere Zustimmung nicht zugänglich gemacht werden.

13. Erfüllungsort und Gerichtsstand 
Erfüllungsort ist unser Geschäftssitz. Gerichtsstand ist das für unseren Geschäftssitz zuständige Amts- oder Landgericht. Allein maßgebend ist das Recht der Bundesrepublik Deutschland, auch bei Auslandsgeschäften.

14. Ablehnung 
Umrüstungen, Sonderbauten, Adaptionen an Rollstühle und sonstige Spezialanfertigungen können abgelehnt werden auch wenn Angebote oder Auftragsbestätigungen erstellt wurden.
